Terms and Conditions

Scope

1. User

2. Scope

2.1. These General Terms and Conditions apply to all legal transactions between the Buyer and the Seller.

2.2. Deviating terms and conditions of the buyer shall not be recognized unless the seller expressly agrees to their validity in writing.

3. Offers and service descriptions

3.1. The presentation and description of the goods on the website of the online shop www.myhappystore.at does not constitute a contractual offer, but rather an invitation to place an order. Service descriptions on the seller's website do not constitute a representation or guarantee; errors are excepted.

4. Ordering process, conclusion of contract and storage of the contract text

4.1. The provisions of these Terms and Conditions apply to orders placed by buyers via the online shop's website www.myhappystore.at.

4.2. The contract is concluded with the seller (see § 1).

4.3. Buyers can select products from the Seller's range of products in the online shop www.myhappystore.at without obligation and collect them in a shopping cart using the "Add to cart" button.

4.4. The buyer will then be directed to complete the order process by clicking on the "Checkout" button.

4.5. By ordering goods by clicking on the “order with payment” button at the end of the ordering process, the buyer submits a binding offer to conclude a purchase contract.

4.6. Buyers will receive an email with the order details. The automatic order confirmation merely documents that the order has been received by the seller and does not constitute acceptance of the application.

4.7. The contract is only concluded when the seller sends an order confirmation by email .

4.8. The contract text is saved when orders are placed.

4.9. After conclusion of the contract, the order data will no longer be visible online.

5. Prices and shipping costs

5.1. The statutory value-added tax and other price components are included in the stated prices.

5.2. Shipping costs are not included in the displayed price and are charged separately. Shipping costs will be clearly communicated to the buyer under "Delivery" and during the ordering process.

6. Delivery, delivery restrictions

6.1. Unless the description of a selected product explicitly states otherwise, delivery will take place within 5-7 working days after the processing time of 5 working days has expired.

6.2. If the selected products are available at the time the buyer places their order, the seller will notify the buyer of this in the order confirmation. If the product is permanently unavailable, the seller will refrain from accepting the order. In this case, no contract will be concluded.

6.3. If the product specified by the Buyer in the order is only temporarily unavailable, the Seller shall also immediately notify the Buyer of this in the order confirmation.

6.4. In the event of a delivery delay of more than two weeks, the Buyer has the right to withdraw from the contract in writing, whereby the contract will be terminated after confirmation by the Seller. Any payments already made by the Buyer will be promptly refunded by the Seller.

7. Payment terms

7.1. Before completing the order process, the buyer can select from the available payment methods.

7.2 For all payment methods, payment must be made in advance without deduction.

7.3. If third parties are commissioned to process payments, e.g. PayPal, their general terms and conditions apply.

8. Retention of title

8.1 The Seller reserves title to the goods until the purchase price has been received in full.

9. Transfer of risk

9.1. The risk of accidental deterioration or accidental loss of the goods shall remain with the Seller until the goods are handed over and shall pass to the Buyer upon such handover.

10. Warranty and Guarantee

10.1. The statutory warranty provisions apply.

10.2. A guarantee shall only exist for goods delivered by the Seller if this has been expressly stated.

11. Liability

11.1. Complaints concerning the scope of delivery, material defects, incorrect deliveries and quantity deviations must be communicated to the Seller in writing by the Buyer immediately after receipt of the goods.

11.2. The Seller cannot accept liability for goods damaged during transport. Noticeably damaged packaging must be reported to the supplier immediately upon delivery.

11.3 The provisions of the Product Liability Act remain unaffected.

12. Right of withdrawal and complaint

12.1. Returns are possible up to 14 days after receipt of the goods. Return shipping costs are not covered by the seller; they must be borne by the buyer. We ask that the buyer notify the buyer of any complaint or return in advance. This allows the buyer to allocate the products to the seller as quickly as possible. 13. Data protection

13.1. The Seller processes the Buyer's personal data for specific purposes and in accordance with the statutory provisions.

13.2. The personal data provided for the purpose of ordering goods (such as name, email address, address, payment details) will be used by the Seller to fulfill and process the contract. This data will be treated confidentially and will not be passed on to third parties.

13.3. The buyer has the right to receive information about his personal data stored by the seller free of charge. In addition, the buyer has the right to correct inaccurate data, block, and delete his personal data, provided there is no statutory retention period to the contrary.

14. Contract language

14.1. The contractual language between buyer and seller is German and English in international cases.
